S C restrains Ali Zafar, Meesha Shafi from filing unnecessary applications

Supreme Court (SC) while nullifying HIGH court order for cross examining the witnesses soon after their statements has restrained both Ali Zafar and Meesha Shafi from filing unnecessary applications.

The court directed trial court not to grant unnecessary adjournments and complete the trial soon.

A 3-member bench of SC presided over by Justice Mushir Alam took up for hearing Model Meesha Shafi versus Additional district Judge Lahore case Tuesday.

Counsel for Meesha Shafi said during the hearing of the case that Meesha Shafi does not know all the witnesses of Ali Zafar. The witnesses are employees of Ali Zafar.

Sabtain Hashmi, counsel for Ali Zafar said no witness is employee of Ali Zafar.

Justice Qazi Faez Isa remarked what is basic objection of Ali Zafar on the petition filed by Meesha Shafi.

Counsel for Ali Zafar said as per law the statement of the witness and cross examination take place on same day.

Justice Isa said that the court has authority to decide whether the recording of statements and cross-examination are done on the same day or not.

Counsel for Meesha Shafi said if list of witnesses is provided then we will conduct cross examination on the same day.

The court on the plea of Meesha Shafi set aside high court orders to cross examine the witnesses soon after their statement and ordered Ali Zafar to file affidavits of the witnesses within seven days.

The court directed that counsel for Meesha Shafi should complete the preparations for cross examination of the witnesses within seven days.
Additionally, the court said that after preparation, the lawyers should try and complete the cross-examination within a single day.
